- Booking: A booking is confirmed only upon receipt of a signed contract and a deposit payment, if applicable. We reserve the right to refuse any booking request.
- Deposit and Payments: A deposit may be required to secure your booking. The remaining balance is typically due prior to or on the day of the shoot, as specified in the contract. Payment methods and schedules will be agreed upon in advance.
- Cancellation Policy: Cancellations may be subject to a cancellation fee, depending on how far in advance they are made. Please refer to your contract for specific terms on cancellations and refunds.
4. Copyright and Usage Rights
- Ownership: All images captured and created by Kelly’s Photography remain the intellectual property of Kelly’s Photography, unless specified otherwise in the agreement.
- Client Usage: Clients are granted a non-exclusive, personal-use license for their images. Images may not be altered, resold, or used for commercial purposes without express written consent.
- Promotional Use: Kelly’s Photography reserves the right to use images from client sessions in promotional materials, portfolios, and social media, unless otherwise agreed upon with the client.
5. Client Responsibilities
- Punctuality: Clients are expected to arrive on time for sessions. Delays may affect the final outcome and completion of the session.
- Permissions: The client is responsible for obtaining all necessary permissions for the use of certain locations or the inclusion of people in the photography.
- Safety and Conduct: We prioritize a safe and respectful environment. Any form of misconduct or unsafe conditions may result in the termination of the session without refund.
6. Limitation of Liability
Kelly’s Photography takes the utmost care with each client’s images. However, in the event of unforeseen circumstances, such as technical failures, Kelly’s Photography’s liability is limited to a refund of the amount paid or a reshoot if possible. Kelly’s Photography is not responsible for any indirect or consequential damages.

8. Governing Law
